A Study on the Small Vessel Notification System - With a Focus on the Comparison of Airplanes·Construction Machinery·Cars Registration System -

This paper proposes the improvement and legislative direction on the small vessel notification system in the Republic of Korea. According to article 8 of the Ship Act, ships of more than 20 tonnes become the subject of registration as a public notification system. But ships of less than 20 tonnes, what is called, small vessels are not compulsory for registration. Therefore, these small vessels make several problems concerning safety at sea, protection of property right, or insurance, etc. Airplanes, Construction Machinery, Cars are movable properties similar to small vessels in terms of public notification. But these movable properties are being well protected legally because they are the subject of public registration. Therefore, I suggest that the new notification system on the small vessels should be adopted in national law like the Ship Act, etc. As a legislative direction, dual notification system of ships must be changed into unified notification system which is registration because unified notification system improves the efficiency of Administration as well as exercises shipowners' property right.
