地籍測量適否審査制度의 改善方向에 관한 硏究 - 中央地籍委員會에 請求된 事件을 中心으로 -

A Study on Improvement of Cadastral Result Inspection System - Focused on the Cases Requested to Central Cadastre Committee -

본 연구의 목적은 중앙지적위원회에 청구된 지적측량적부심사 대상 토지의 실태를 조사·분석하고, 이를 토대로 지적측량적부심사제도의 문제점을 도출하여 이에 대한 개선방향을 제시하는데 있다. 연구 범위는 1985년 1월 l일부터 1999년 12월 31일까지 중앙지적위원회에 청구된 토지 56건을 대상으로 하였다. 연구방법으로는 역사적 접근방법을 사용하였고, 조사방법은 문헌조사법을, 분석방법은 기술적 분석법(記述的 分析方法)을 사용하였다. 분석 결과, 지적측량적부심사제도의 문제점으로는 첫째, 중앙지적위원회의 구속력 부족 둘째, 측량자와 청구자의 의견제시 기회 부족 셋째, 현지조사에 대한 신뢰성 부족 넷째, 중앙지적위원회 구성의 합리성 결여로 나타났다. 개선방향으로는 첫째, 지적법 개정을 통한 중앙지적위원회에 구속력 부여 둘째, 청구인 및 측량자의 위원회 참여 기회 부여 셋째, 지적조사전담팀에 의한 현지조사 실시 넷째, 지적측량관련 법률가의 추가 위원 선임 다섯째, 중앙지적위원회의 성격을 행정소송의 전치수단으로 전환 등으로 제시되었다.

The purpose of this study is to find out problems of Cadastral Survey Result Inspection(CSRI) System by investigating and analyzing actual condition of the land of CSRI requested to Central Cadastre Committee(CCC) and to propose the right direction to improve the system. The study has been focused on 56 CSRI cases requested to CCC from January I, 1985 to December 31, 1999. Historical approach was used for the study method while doing the literature search method. Descriptive analysis was applied as the analysis method. As the result of the analysis, the problems of CSRI are lack of following matters. . Binding power of CCC . Chances to present opinions of applicants and surveyors . Reliance on field inspection . Propriety of composition of CCC Conclusively, the solutions presented in this paper are as follows . Endow CCC with binding power by an amendment of Cadastral Law . Offer opportunities for applicants and surveyors to participate CCC . Charge the cadastral specialists team with filed inspection . Appoint lawyers relevant to cadastral survey as the additional members of CCC . Convert the characteristic of CCC to preceding method of administrative litigation
