The source of the marine traffic rules in Korea is based on the International Regulations for Preventing Collisions at Sea 1972, the Marine Traffic Safety Act and the Public Order in Open Port Act. The Marine Traffic Safety Act considering the geographical circumstance, the characteristic of fairway and waters, traffic environment in coastal waters prescribes the establishment and management of the specified waters for the traffic safety, the traffic prohibited area for tanker, the appointment of fairway in a narrow channel, and marine vessel traffic control system(VTCS) etc.. The Public Order in Open Port Act prescribes the establishment of traffic channel and special navigational rules for preventing collision in harbor, also require to use this route and keep the rules for vessel. But it is not required to use for vessel the course which is established in out of harbour limit and there is a conflict for the concept and operation between the VTCS and port traffic management service.. Therefore, this paper aims to discuss the meaning of the rule concerned in the view of legal basis and suggest the amendments necessary to the marine traffic rules for marine traffic safety and proper management of route and waters.
