The P & I clubs advise that in some difficult causes a member may not be certain whether or not the normal P & I war risks exclusion would apply to the particular circumstances of an incident. Should this uncertainty continue even after an incident has occurred, the P & I club member may be left in doubts as to whether his claim is covered by the association or not. Similarly, there are borderline situations between circumstances in which a claim can be paid by the association and those in which a similar claim is excluded, for example, when there is terror risk(terrorist activity). Recent experiences have suggested that incidents falling within the definition of war risks are becoming more and more frequent and they are by no means confined to areas where it is known that an armed conflict is in progress. There are many members of the P & I clubs that will have some cover against P & I liabilities from their war risk underwriters. However, it is quite possible that the wording of the relevant war risk policy may not exactly mirror the wording of the P & I club's exclusion. Furthermore, the coverage available from war risks underwriters is normally subject to a limit of liability, sometimes set at a relatively low level. Therefore, this additional cover for war risk situations, being given by the P & I clubs, will cover such claims that are excluded under the normal P & I association war risk exclusion rule. This additional coverage from the clubs would respond only to the extent of what each and every member is unable to recover from his normal war risks policies. This paper aims to review the coverage availability of terror risk in P & I insurance.
