This study dealt with bellow questions. 1. A voidable marriage is a valid and subsisting marriage unless and until it is annulled. The effects of a annulment of marriage is not retroactive(Civil Code 824). then in a relation of a voidable marriage when it was annulled and one party or both parties was acquired property. Could the other party or both parties claim it? 2. A bigamy, at the time of the marriage, either party was already lawfully married to a third party. it is a voidable marriage (Civil Code 816. 2). (1) In a relation of a voidable marriage, when it was annulled and one party or both parties of the marriage was acquired property. Could the other party or both parties claim it? (2) In a relation of a bigamous marriage, when the bigamist did not conduct the annulment of marriage and died, in later it was annulled. In the case Could the surviving spouse have the succession right.
