貿易去來 電子化에 따른 信用狀去來에서의 書類의 原本과 寫本-UCP 500의 규정과 영국의 판례를 중심으로-

Original document and Copy in the Letter of Credit Transaction in accordance with Electronic Trade-With special reference to UCP Provision & Case Study in England-

This paper purposes to suggest a better form of the provisions regarding the original document and the copy in UCP by analysing the related articles in UCP and examining a case study conducted in England. The conclusion of this study is as follows. The UCP Provision 20(b) should be revised as follows : “Banks will also accept as an original document(s), a document(s) produced or appearing to have been produced : ⅰ) by reprographic, automated or computerized systems ; ⅱ) as carbon copies ; provided that the document is signed by handwriting although it is not marked as original.”
