A Study on the Provisions of Control of the Discharge of Sewage and Garbage into the Sea

This paper deals with 2 issues on the provisions of controlling the discharge of garbage and the discharge of sewage into the sea. It carried out comparative analyses in relation to the issues between Korean Marine Pollution Prevention Act and the International Convention for the Prevention of Pollution from Ships, 1973, as Modified by the Protocol of 1978 and 1997 relating thereto, as amended. It highlighted the various problems regarding the issues above and tried to reveal where the problems lie. Then it provides various solutions against the problems in order to remove inconsistency and irrationality in Korea Marine Pollution Prevention Act and its decree. Such solutions include amending definition of the marine wastes, establishing adequate collection system for garbage, rationalization of the provisions of the discharge of garbage and sewage into the sea, developing and distributing handy type sewage pollution prevention equipments, etc. It also emphasizes that the Government should promptly undertake to ensure the provision of facilities at ports and terminals for the reception of sewage and garbage, without causing undue delay to ships using them to implement the obligation required by the MARPOL 73/78 Convention, as amended.
