地籍判例變更에 따른 地籍界의 對應 戰略 硏究 -大法院 2003두9015 判決을 中心으로-

A Study on the Counter-Measure of the Cadastral World against Change of Cadastral Case -Focused on the Supreme Court Case 2003 Du 9015-

본 연구의 목적은 지적판례변경에 대한 실태를 조사ㆍ분석하고, 이를 토대로 지적판례변경에 대한 지적계의 대응 전략을 제시하는데 있다. 이상과 같은 연구목적을 효율적으로 달성하기 위해 연구대상을 지적판례변경으로 한정하고, 연구방법으로서 접근방법은 법률적 접근방법을, 조사방법은 문헌조사법과 판례조사법을, 분석방법은 비교분석법과 기술적 분석법(記術的分析法)을 사용하였다. 분석 결과 지적판례변경에 대한 지적계의 대응 전략은 먼저, 지적학계는 기존 지적판례에 대한 법리의 타당성을 지적학 측면에서 검증해야 하며, 이를 위해서는 지적활동에 대한 기초이론의 개발에 최선의 노력을 경주해야 할 것이다. 지적관계는 지적업무에 대한 다양한 행정소송에 대비해야 하며, 이를 위해서는 지적업무에 대한 지적공무원의 전문적인 이론무장이 요구된다. 진적업계는 내적으로 지적조사에 대한 정확성을 확보하는 방을 강구하고, 외적으로는 지적학계에 대한 연구지원사업을 확대해야 할 것이다.

The purpose of this study is to investigate and analyze the actual condition of change of cadastral case while presenting the counter-measure by the cadastral world for change of cadastral case. To achieve the above study purpose efficiently, the study object was focused on change of cadastral case using legal approach method in terms of the approach method, literary investigation and precedents survey in terms of the investigation method and comparative analytic method and descriptive analytic method in terms of comparative and analytic method. As a result of analysis, it is important that the cadastral world should verify first the legal soundness on the existing precedents from the cadastral standpoint for a counter-measure of the cadastral world for change of cadastral case and to this end more efforts should be made for the development of the fundamental theory of the cadastral activity. The cadastral official world must be in preparation for different administrative lawsuits and those civil servants who are with the cadastral work should have more professional theories. The cadastral business world should try to find a way to secure the accuracy on the cadastral survey internally while expanding the project to support the cadastral academic world for the study externally.
