地籍民願의 解決을 위한 國民苦衷處理委員會의 限界性 硏究

A Study on the Limitation of the Ombusman of Korea to Solve the Cadastral Complaint

본 연구의 목적은 국민고충처리위윈회에 접수ㆍ처리된 지적민원의 실태를 조사ㆍ분석하고, 이를 토대로 지적민원의 해결을 위한 국민고충처리위원회의 한계성을 제시하는 것이다. 이상과 같은 연구목적을 효율적으로 달성하기 위해 시간적으로는 2003년 1월 1일부터 2003년 6월 30일까지로 하고, 공간적으로는 국민고충처리위원회를 중심으로 하면, 내용적으로는 국민고충처리위원회에 접수된 민원 중 지적민원 68건을 대상으로 한정하였다. 이상을 연구하기 위한 방법으로는 역사적 접근방법을 사용하고, 조사방법으로는 문헌조사법과 사례조사법을 병행하며, 분석방법으로는 記述的 分析法을 사용하였다. 분석 결과, 지적민원의 해결을 위한 국민고충처리위원회의 한계성으로는 조사권의 한계성, 技術的接根의 한계성, 민원처리 능력의 한계성, 처분실효의 한계성으로 제시되었다.

The purpose of this study is to investigate and analyze the present conditions of the cadastral complaint received and processed by the ombusman of Korea and with the background it is aimed at suggesting the limitation of the ombusman of Korea to solve the cadastral complaint. To achieve the purpose of the study as abovo efficiently, tbe study was focused on from Jan 1, 2003 to June 30, 2003 mainly with the ombusman of Korea in terms of the space but also targeting 68 cadastral complaints roceived by tbe ombusman of Korea in terms of tbe contents. Historical approach was used for the above study metbod while doing tbe case study along with tbe literature investment method at tbe same time Meantime, a descriptive analysis method was used for the analysis method. As a result of the analysis, tho limitation of the ombusman of Korea showed resulting in the limitation of the investigation right, limitation of technical approach, limitation of civil complaint processing capability and limitation of the processed validity.
