The Real Life of North Korean Women in China : The Issue of Their Refuges Status

1990년 이후 북한의 경제사정 악화와 식량난 및 사회통제의 약화 등으로 북한을 탈출하여 중국에 불법적으로 거주 또는 은신하고 있는 탈북자는 수만에서 수십만 명에 달하는 것으로 추정되며 이들 중 대다수가 여성으로 파악되고 있다. 이렇게 여성의 월경(越境) 비율이 높은 이유는 전통적으로 가부장적 성향이 짙은 북한사회에서 식량을 구하는 일은 여성의 몫 이며 직장에 소속되어 있지 않은 여성이 장기간 이동하는데 유리하기 때문이다. 그러나 식량난에 대처하는 과정에서 북한 여성들은 인간의 존엄성을 무시당한 채 타국에서 체포와 북한으로의 강제송환의 공포 속에서 불안한 나날을 보내고 있으며 인신매매·매춘·폭행·구걸 등 비인간적인 일들을 겪으면서 기본적인 인권마저 보장받지 못하고 있는 것이 실정이다. 이러한 시점에서 탈북여성의 중국체류 현황과 인권문제를 전반적으로 재 조명해보고 이들에 대한 실질적 보호수단 마련과 대책방안을 논의해 볼 필요가 제기된다. 따라서 본고에서는 이들 탈북여성들이 국제난민으로서 정당한 보호를 받을 수 있도록 그 당위성에 대한 여론을 환기시키고 이를 통해 주변 관련국, 특히 중국의 탈북자 해결원칙을 중심으로 중국의 난민에 대한 인식을 분석해보고자 한다.

North Korea's continuing economic woes, its deepening food shortage, and its attendant weakening of social control-particularly since the early 1990s-have all contributed to the growing number of North Koreans who are illegally residing or hiding out in China. There are no official figures on their number; however, they are estimated to range from tens of thousands to hundreds of thousands. Moreover, the majority of them are females. The reasons for a higher rate of female portion are not hard to fathom. In a traditional and patrimonial North Korean society it is the women's job to find food. Additionally, the females who do not belong to a regular job are easier to take a long journey without being detected. In the long and arduous search for food in a foreign country the North Korean women are caught between the rock of arrests and the hard place of repatriation back to North Korea. Being deprived of the human dignity, they suffer from the daily violation of their basic human rights. Even worse, human trading, prostitution, violence, and begging are more common encounters. It is thus necessary and timely to take stock of the current state of the North Korean women in China, their human rights abuses, and any realistic measures to help protect them. In particular, this essay delves into the issue of the international refugee status which would basically ensure their legal rights. In addition, this study sheds some light on the current perceptions and policies on the subject by China, its neighboring countries, and the international community.
