장애의 이론 모델과 실천 모델의 전환에 입각한 「장애인복지법」 개정 방향

Directions for the Amendment of the Welfare of Disabled Persons Act Based on a Shift in the Theoretical Models and Practice Models of Disability

  1989년 장애인복지법이 전문 개정된 이래, 동 법은 수차례 개정되어왔고 2005년에 들어서면서부터 다시 개정되려는 움직임이 있어왔다. 본 연구는 우선 장애의 이론 모델(의료적 모델 대 사회적 모델)과 실천모델(재활 모델 대 자립생활 모델)을 정리하고, 이어서 현행법과 제출될 개정안들을 평가했다. 연구 결과, 이 개정안들 역시 장애에 관한 여러 모델들이 혼재되어 있는 현행법의 모습을 크게 벗어나지 못하고 있었다. 이에 본 연구는 장애의 이론 모델과 실천 모델에서의 전환에 입각하여 현행법의 개정 방향에 대해서 몇 가지 제언을 하였다.

  The Welfare of Disabled Persons Act has been amended many times since the Act was amended in full in 1989, and it is about to be amended again. This study first intended to pull the theoretical models (medical model versus social model) and practice models (rehabilitation model versus independent living model) of disability together. Subsequently, the study examined the existing Act along with its revised bills to be introduced.   The findings revealed that the revised bills were also failing to break the limits of the existing Act, where various models of disability were mixed. Hereupon on the basis of a shift in the theoretical models and practice models of disability, the study made several suggestions for the amendment of the existing Act.
