This paper intends to analyse legal status and role of the institutional framework of the european union(EU) in the Treaty establishing a Constitution for Europe("European Constitution"). The european constitution has seven institutions, but it distinguish in particular the institutional framework and the other institutions. The latter contains two institutions, i.e., the European Cental Bank and the Court of Auditors, and the former is composed of the European Parliament, the European Council, the Council of Ministers, the European Commission and the Court of Justice. In regards of actual institutional regime, the european constitution has introduced some new system; i) competence of the european parliament was strengthened for example in the field of decision-making procedure, ii) the presidency of the EU("the European Council President") will be established for a term of two and a half years, renewable once. iii) the Union Minister for Foreign Affairs will be appointed by the European Council. He(or She) will ensure the consistency of the EU's external action.
