An Empirical Study on Busan Trading Firm"s Perception of Mediation System

  As the volume of international trade is increasing and business environment becomes complex, chaotic and competitive, disputes in trade are also increasing and become more complex. However, few study on the ways of dispute settlement under the changed international business environment has been done. This paper aims at helping Busan"s trading firm settle their dispute settlement through mediation efficiently. Thus this paper examines Busan"s trading firm"s perception on the mediation system and the effects of the advantages of mediation and quality of mediator on the outcome of mediation.   The results show that mediation is an useful dispute resolution when parties want to keep their trade continuously in spite of stalemate and when the mediator wins the disputant"s trust through listening and that mediation is an unuseful dispute resolution when a claim amount is small. Though this paper has several limitations, this paper may contribute to figure out the relationship between mediation merits and quality of mediator and its outcomes as a first empirical paper and to suggest future research method and direction.
