In the CIF and CFR contracts the point of delivery is when the goods cross the ship s rail, when risk of loss prima facie passes to the buyer. The packaging forms part of the goods, so that if the goods are damaged or deteriorated during transit due to defective or inadequate packaging, the seller will be liable. Where the seller makes the carriage arrangements, his liability may also be extended to cover loss or damage in transit if he does not make a reasonable contract with the carrier.<BR> The purpose of this paper is to explain the exact meaning of the various transit risks, for instance, the increasing risk of transport cost, deteriorated risk, risk of loss due to internal and external elements of cargo etc. For the these studies, in this paper is taking from the various cases on the CIF and CFR terms, English Law, CISG and Incoterms is frequently using as a pattern of international trade contracts.
