고령화 소자화 사회에 있어서 복지 서비스 담당자로서 각종 비영리단체가 주목을 받고 있다. 본 논문은 복지 분야에서 비영리조직의 역할을 활성화시키기 위한 제도적 정책적 방향을 시사하는 것을 목적으로 하고 있다. 첫째, 비영리단체 중 복지 단체의 현황을 고찰하고 소자화와 고령화가 한층 가속적으로 진행되고 있는 큰 사회적 문제틀 해결하는 유력한 존재로서 비영리복지단체의 위치를 명확하게 한다. 둘째, 일본에서 사용되어 지고 있는「비영리법인」이나「비영리사업」의 개념을 분명히 하고, 영리와 비영리의 구별 기준을 사업 활동 내용에 입각해서 판단할 필요성이 명확해졌다. 그리고 시장 경쟁에 있어 비영리복지단체와 민간 기업 사이의 경쟁 조건 등이 검토되었다. 셋째, 고령자 케어 단체를 사례로 한 해외의 시행 상황 고찰을 통해 일본의 비영리복지단체의 제도적법적 인가 조건이나 지원 정책 등을 시사했다. 넷째, 복지 서비스에서는 전문성이나 자격을 필요로 하는 경우가 많고, 정보의 비대칭성이 존재하는 것을 확인했다. 또한 서비스를 받는 측은 그 서비스를 평가하는 능력 부족의 문제도 존재한다. 이 경우, 비영리단제, 영리단체, 자치제 등에 의해 행하여지는 서비스 공급의 경제적 효과 분석에 의해 영리기업의 참가 확대보다 비영리복지단체의 서비스를 보다 폭넓게 추진 할 수 있는 규제완화와 재정면에서의 방책이 중요하다. 이상의 분석을 통해 민간 비영리복지단체의 복지 서비스 시스템의 구축과 함께 정부의 종합적인 복지정책의 목표 설정과 정책 수단의 개선 등이 요구되고 있다.
This paper aims at promoting nonprofit organization (NPO) institutionally and politically in the welfare field. Firstly, we investigate the present situation of the NPO for welfare, which are playing a leading role in solving the social problems of an aging society with a decrease in birthrate in Japan, which are becoming serious. Secondly, this paper clarifies the concepts of "nonprofit corporation" and "nonprofit business" in Japan, and the standards for distinction profit and nonprofit business. Further more, the competitive conditions between nonprofit welfare organizations and private enterprises were also examined. Third, based on NPO activities for old people cares overseas, we suggest the policies and approval conditions institutionalIy and leally for a NPO to support old people. Lastly, this paper analysis thc economical effect of the service supplied by a NPO, a profit organization or self-governing body, and indicates the importance of regulations and financial policies for expanding welfare services provided by a NPO, rather than an enterprise seeking profit. The target for a comprehensive government welfare policy and its improvement are also set up.
