국무위원 인사청문회 제도의 문제점 - 게임이론을 통한 분석을 중심으로

An Analysis on the Problems in the Rules of the Korean Congressional Hearing for Cabinet Members: An Application of Backwards Induction

  본 연구는 한국의 국무위원 인사청문회와 관련된 제도적 문제점을 게임이론을 통해 분석하였다. 특히 본 연구는 미국과 한국의 인사청문회 제도를 비교론적인 관점에서 고찰하여 그 차이점을 살펴보았으며, 지난 2006년 2월 치러진 유시민 장관 내정자의 인사청문회 진행과정을 하나의 사례로 선정하여 ‘역방향 귀납’(backwards induction) 방식에 입각한 게임이론을 적용함으로써 한국의 국무위원 인사청문회 제도가 지니는 제반 문제점을 고찰하였다. 연구 결과, 유시민 내정자의 인사청문회 과정에서 노무현 대통령이 인사 청문회 직전까지 야당은 물론 여당의 반대에도 불구하고 유 내정자를 장관으로 선임하고, 여당인 열린우리당이 자신들의 반대 입장을 철회하여 찬성으로 선회한 것은 결국 한국의 인사청문회가 지니는 제도적 맹점이 주요한 요인으로 작동한 결과였다. 한국의 인사청문회 제도는 미국의 그것과 비교하여 국회가 인사청문회를 준비하기 위한 기간이 지나치게 부족하고, 특히 국회의 임명비준권이 존재하지 않음으로써 대통령은 인사청문회 결과와 상관없이 자신의 선호와 의지대로 국무의원을 임명할 수 있다는 것이다. 결과적으로 ‘견제와 균형’의 원리에 입각하여 대통령에 의한 자의적인 인사임명권 발동을 견제하기 위해서는 우선 국회가 인사청문회를 준비할 수 있는 시간적 여유를 충분하게 제공하고, 이와 더불어 대통령이 국무위원 임명권을 발동함에 있어 보다 신중을 기할 수 있도록 국회의 임명비준권이 부여되는 방안을 심각하게 고려해 보아야 할 것이다.

  The Purpose of this study is to analyze the problems inherent in the rule of the Korean congressional hearing for cabinet members. In order to do so, this study first tries to pinpoint the problems in the rule by comparing it with the confirmation process conducted in the U.S.A. The analysis indicates that the most serious problem in the rule is that there is no effective institutional tool left for the members of the National Assembly to check the decisions of the president on the selection of cabinet members. This problem plays an important role in decreasing the president"s uncertainty in the confirmation process and, in turn, enhancing his incentive to bypass the preferences of the National Assembly when nominating his cabinet members. And this study has made an attempt to show how serious the problem is by applying the backwards induction to the game between President Roh Moo-Hyun and Woori Party on the congressional hearing for Ryu Si-min, the nominee for the Minister of Health and Welfare.
