국제안전관리규약(ISM Code)에 대한 소고

Some Considerations on the ISM Code and its Implementation

  국제안전관리규약은 국제해사기구 총회 결의에서 채택한 선박의 안전 운항 및 오염예방을 위한 국제적 관리규약이다. 1974년 국제해상인명안전협약 제9장에서 새로이 채택된 규정을 포함한 이 협약의 1998년 7월 1일자의 발효와 함께 국제안전관리규약은 해당 선박에 강제되도록 하고 있다. 따라서 이 논문에서 저자는 ISM Code 규정 및 그 시행상의 몇 가지 문제점에 대한 개선방향을 제시하고자 한다. 예컨대 선사에서 설립한 절차에 따른 안전관리체제의 효율성을 높이기 위하여 안전관리적합증서(DOC)와 선박안전관리증서(SMC) 통합을 고려할 필요가 있다. 또한 국제안전관리규약 4 에서 규정하고 있는 안전관리책임자에 대하여 어떤 일정한 공식적인 자격증을 갖도록 할 필요가 있다. 왜냐하면 선사의 최고책임자나 선사측에서는 공식적인 특정 자격증이 없는 안전관리책임자를 임명하여 단지 선박의 안전 운항을 확인하고 선박 승무원들과 선사와 연결하는 역할로 그를 지정하고 있기 때문이다.

&nbsp;&nbsp;International Safety Management Code means the International Management Code for the Safe Operation of Ships and for Pollution Prevention adopted by Resolution of IMO Assembly.<BR>&nbsp;&nbsp;With the entry into force, on 1 July 1998, of the amendments to the International Convention for the Safety of Life at Sea 1974, which is newly provideded on chapter IX of the Convention, the International Safety Management Code has been mandatory to the related vessels.<BR>&nbsp;&nbsp;So the writer, in this theme, suggests the improvements of some probrems on the ISM Code and its implementations.<BR>&nbsp;&nbsp;For example, it is to regard consolidation of the Document of Compliance(DOC) and the Safety Management Certificate(SMC) for elevating the efficiency of the Safety Management System in accordance with procedures established by the Company.<BR>&nbsp;&nbsp;Also the Designated Person(s)(D.P.) provided on ISM Code 4 need(s) to get a certain official Certificate. Because CEO(or The Company) only designate him(them) to Designated Person(s). for ensuring the safe operation of each ship and to provide a link between the Company and those on board.
