日本의 船舶衝突과 관련한 航法에 대한 比較法的 硏究

A Comparative Study on the Japanese Marine Traffic Regulations regarding Collision

&nbsp;&nbsp;선박의 운항은 국제적인 성격을 가지고 있으므로 선박충돌과 관련한 항법규정은 국제적인 통일성이 요구된다. 그러나, 각국은 자국의 영역에서는 자국법을 제정하여 실시할 수 있기 때문에 우리 나라 선박이 일본에 기항하게 되는 경우에는 일본의 해상교통법이 적용된다. 그러므로, 일본 국내법 규정에 대한 숙지가 필요하다.<BR>&nbsp;&nbsp;일본의 해상교통법의 체제는 우리 나라와 유사하지만, 일본의 港則法(우리 나라의 개항질서법에 해당)의 피항방법은 상호시계에서만 적용되고, 추천항로가 법적 구속력을 가지고, 협수로 등에서 어로작업중인 선박과 소형선이 더 보호받는 점에서 그렇지 않은 우리 나라 법과 차이가 있다. 이러한 점은 우리 나라 선박의 일본내해에서의 항해에 참고가 되어야 한다. 그러나, 우리 법에의 해석에 있어서 일본법과 동일한 특별규정을 가지고 있지 않은 경우에는 일본법의 해석을 직접 우리 법에 적용하는 것은 피하여야 할 것이다.

&nbsp;&nbsp;Shipping business is an international business. The vessel travels all over the world and thus there is a strong needs for the application of a uniform regulation on every vessel regardless of nationality in order to prevent collision at sea. However, every state has their own right to make a separate national law and implement it over their territorial water. Korean flagged vessels should abide by the Japanese local regulation when they navigate within the Japanese territorial waters including internal waters. As a result, the need for study of Japanese marine traffic regulation is enhanced.<BR>&nbsp;&nbsp;The basic systems of the marine traffic regulation are very similar to those of Korea. Japanese laws are different from Korean laws in several aspects: (1) the duty to keep out of the way is applicable only in the case that vessels are in sight of one another under Open Port Ordinance Act; (2) the recommended route has legal binding power; (3) the vessels engaged in fishing and small vessel have a kind of privilege over other general power-driven vessel.<BR>&nbsp;&nbsp;The officer in charge of the navigational watch should pay attention to those differences when they navigate within the Japanese territorial waters. The direct application of the Japanese law for Korean law should be avoided in case that the Korean law does not have the same special provision as that of Japan.
