&nbsp;&nbsp;이 글은 1978 STCW 협약과 그 개정 규정에서 규정하는 항만국통제의 핵심 개념을 요약한다. 그리고 동 협약과 관련하여 항만국통제에서 제기되었던 몇 가지 중요한 쟁점사항을 검토한다.<BR>&nbsp;&nbsp;하나의 중요한 쟁점사항은 해기면허증의 기재방법 예컨대 부적절한 유효기간, 기능과 등급의 기재의 필요성에 관한 해석이 차이, 직무의 제한에 관한 불충분한 표시 등과 관련되었다. 또 하나는 탱커기초교육과정 또는 탱커직무교육의 대상자와 교육이수증에 탱커교육과정의 유효기간을 명시하여야 하는 지의 여부에 관한 것이었다. 승인된 승무경력을 증명하는 수단 역시 쟁점이 되었다. 또 다른 쟁점사항은 최저안전배승증서의 최신양식에 관련된 것이었다. 이 논문은 이들 쟁점사항에 관한 여러 가지 문제점을 분석 부각하는 시도를 하였고 문제의 근원을 밝혔다. 쟁점사항에 대한 해결방안 또는 해명을 제시하였다.<BR>&nbsp;&nbsp;그 해결방안에는 해기사면허증의 기재방법의 개정, 탱커교육과정의 해명, 승무정원증서의 최신화 등을 포함한다. 당직규정, 근로시간, 휴식시간 등과 관련한 항만국통제에서의 결함 또는 출항정지 사항도 또한 제시하였다. 결론적으로 항만국통제에 있어서 부당한 결과를 회피하도록 하기 위하여 각 관계 당사자는 통제조치를 적절하게 실시하도록 할 것을 권고한다.

&nbsp;&nbsp;This paper summarizes the key notion of Port State Control Provisions provided in the 1978 STCW Convention as amended. Then it deals with some important issues raised by the Port State Control in relation to the Convention.<BR>&nbsp;&nbsp;One important issue was related to the methods of completing certificate of competency such as inadequate validity, different interpretation on the necessity of recording of functions and level, insufficient indication of limitation of capacity, etc. Another one was related to whom shall be required to undergo tanker familiarization course or specialized training programs, and whether the validity of tanker training courses need to be indicated or not in the relevant training certificates, etc. Means of proving approved seagoing service also became an issue. Another issue was related to the latest format of minimum manning certificate.<BR>&nbsp;&nbsp;Then this paper tried to analyse and highlight the several problems regarding the issues and reveal where the problems lie. Various solutions or clarifications against the issues are also provided. Such solutions include the revision of completing methods of the certificate of competency, clarification of tanker course issues, updating the format of minimum manning certificate, etc. Deficient or detention items in the Port State Control relating to watchkeeping provisions, hours of work, hours of rest, etc. are also highlighted. It finally recommends that countermeasures should appropriately be taken by each interested party in order to avoid undue result of the Port Sate Control.
