끼워팔기(Tying)와 결합판매(Bundling)의 규제법리의 비교와 규제체계 정립에 관한 고찰

  끼워팔기(Tying)와 결합판매(Bundling)는 특정한 시장에서 지배력을 갖고 있는 사업자가 상품간의 판매를 결합하는 것을 규제하는 대상을 지칭한다는 점에서 행태적으로 유사하다. 그러나 규제법리의 발생과정이나 경쟁정책적 의의에 있어서 끼워팔기와 결합판매의 규제는 상이하며, 이에 관한 비교분석을 통하여 합리적인 규제체계를 모색할 수 있을 것이다.

&nbsp;&nbsp;There are similarities in light of mechanism and behavior between tying and bundling. They have common character, that in supplying one&quot;s commodities or services to a transaction partner, one forces the partner unreasonably, to purchase another commodity or service from oneself or an enterprise whom one designates. But in spite of a systematic similarity, there are differences in light of competition policy between tying and bundling.<BR>&nbsp;&nbsp;The regulation of tying is to maintain a competition, but the regulation of bundling operates to form a competition on the field of regulated industry, as telecommunication industry.<BR>&nbsp;&nbsp;Therefore it is essential that the regulation of tying on antitrust law and the regulation of bundling on telecommunications law are in existence for an operation of competition mechanism on telecommunications field. And on the basis of the understanding of difference in light of competition policy, we try to accomplish a systemization and harmony of regulations of tying and bundling.
