북한의 급변사태와 남한의 관할권 확보방안

A Study on the Ways for South Korea to Secure Jurisdiction over North Korea in Case of Its Emergency Situation

  이 논문은 제2차 북핵위기 이후 핵, 미사일, 인권, 국제적 불법거래 등 이른바 ‘북한문제’와 관련한 유엔 등 국제적인 대북압박이 강화되는 상황 하에서 북한급변사태 발생 가능성이 높아졌다는 가정 하에 북한급변사태 시나리오와 북한급변사태 발생시 주변국의 개입가능성을 검토하고 있다. 이와 함께 북한급변사태시 한국의 대북 관할권 확보를 위한 다차원적인 접근방안을 제시하고 있다. 북한급변사태시 중국을 비롯한 주변국의 개입 가능성은 매우 높으며, 1950년 가을의 상황을 고려할 때 북한급변사태시 유엔안보리에서 한국의 대북 관할권을 인정받기는 쉽지 않은바, 북한급변사태시 한국의 대북 관할권 확보를 위한 국제, 남북관계, 국내 차원의 평시 노력이 꾸준히 전개될 필요가 있다.

  Since the so-called 2nd nuclear crisis, international community has further-increased coercive pressures on North Korea because of its past mischiefs, In this development, the North Korean emergency scenario seems to become more plausible. This paper examines the scenario and also the neighboring countries’ possible intervention in North Korea. At the same time this paper suggests multi-dimensional approaches to secure ROK’s jurisdiction over DPRK in case of emergency. Considering what happened in the autumn of 1950, intervention of four powers including China is likely to happen and UN Security Council wouldn"t allow South Korea to receive jurisdiction over North Korea. Therefore, South Korea should maintain its national and international efforts to secure jurisdiction over North Korea in case of emergency.
