A Study on Methods for Rational Operation of Land Use Regulations - Focusing on the Regulated Law of Zoning -

CONTENTS<BR>&nbsp;&nbsp;(1) RESEARCH OBJECTIVES<BR>&nbsp;&nbsp;As various laws and ordinances on the basis for administrative activities are enacted. amended and scrapped by the convenience of each administration, we, come to experience the inconvenience of overlapped regulations. This study investigates for the reasonable operation of zoning as a typical mean of land use regulations.<BR>&nbsp;&nbsp;(2) RESEARCH METHOD<BR>&nbsp;&nbsp;The study examines to the related documents from the Ministry of Construction and Transportation : the Ministry of Environment : the Ministry of Administration and Home Affairs ; and Korea Forest Service. In particular, the paper also studies the government data, relevant laws and ordinances and examples of foreign legislations. The paper, then, conducts interviews with law drafters as well.<BR>&nbsp;&nbsp;(3) RESEARCH RESULTS<BR>&nbsp;&nbsp;As of May of 2005, a total of 338 zonings were designated in accordance with 126 laws of the nation&quot;s 14 ministries and offices. Among them, the zonings related win the land use regulation are analyzed to be 203 according to 67 laws. There are the issue of the use of standardized terminology due to an imprudent designation of zoning, a lack of preparations for managerial aspect, and the difficulty of understanding the content of regulations on acts in case of overlapped designation, and thus many instances, accure of undermining an efficient use of land.<BR>&nbsp;&nbsp;2. RESULTS<BR>&nbsp;&nbsp;In order to improve the land use regulation, the system of zoning is amended ; the unreasonableness of the designating procedure corrected, the transparency of regulation on acts is enhanced, and the clarity of the objective of designation and standardization on terminology is improved.
