지적측량적부심사 제도의 발전방안에 관한 연구 - 서울특별시 지방지적위원회를 중심으로

A study on the development of cadastral surveying screening system - The case of Seoul Cadastral Committee -

&nbsp;&nbsp;토지경계는 소유권이 미치는 한계로서 매우 중요한 역할을 하고, 우리나라는 도상경계를 법정 경계로 사용하고 있어 지적측량에 따른 경계분쟁이 빈번히 발생하고 있어 이를 해결하기 위하여 지적측량 적부심사 제도를 운영하고 있다.<BR>&nbsp;&nbsp;본 연구의 목적은 지적측량의 분쟁해결을 위한 지적측량적부심사의 실태를 분석하여 문제점 및 발전방안을 도출하는 것이다. 연구결과 적부심사의 발전방안으로는 적부심사결과에 대한 구속력 부여, 지적직공무원의 조사측량, 청구인과 지적측량기술자의 회의참여, 적부심사제도의 개선, 적부심사 청구비용징수, 지방지적위원회 구성의 개선 등이 필요한 것으로 나타났다.

&nbsp;&nbsp;Land parcel boundary which is legally decided by the map boundary has very important role on the limits of ownership. To solve the frequent boundary controversy, the cadastral surveying screening system is operated by municipalities. The purpose of this research is to analyze the current status and problems of cadastral surveying screening system and to show the development plan for the system. The results of this research are as follows: to carry legal binding force as to the screening decisions, to allow of the surveying to the cadastral officers, to include the applicants and cadastral surveyors as the regional cadastral committee member, to levy screening expenses on that, and to reform the screening system and the composition of cadastral committee, etc.
