A Study on Actual State of Economic Crime - Centering on corporate crime, industrial property right crime and industrial spy crime -

  The economic crime is a crime which prevents operation of economy by breaking the general faith from economic system or all spheres. Economic crime in a classical meaning is mainly issued in area of corporate crime. And if economic crime can be prevented simply with criminal sanction against individuals, corporate crime may not be asked for practical criminal responsibility effectively. The purpose of this study is to review and analysis the field of corporate crime related to corporate economy in particular. Also, this thesis approaches systematically by treating a crime matter related to economy not by suggesting measure of economic matter in Korea. Every corporation has the most important purpose, "profit" which means much benefits through economic activities and a pursuit of this purpose is sometimes operated with lawful means or unlawful means. In particular, adequate measures including social control and legal sanction should be taken to protect the industrial technology and prevent the extrusion of advanced industrial technology effectively. A legislative measure and analysis of actual state of corporate crime related to corporate economy can be led to give a solution of individual economic crime.
