A Study on Charter Party Contract Subject to Agreement on the Detailed Terms

&nbsp;&nbsp;With the wide use of telephones and telex machines for charter negotiations, the chartering practice has evolved negotiation on the main terms, in which the major items of a charter party can be discussed. If the agreement on the main terms can be reached, the parties embark on detailed charter party negotiation. Under American law, there may be a contract once the main terms have been negotiated and agreed. Under English law, however, there is no binding contract at this stage, until each and every details of the contract has been agreed.<BR>&nbsp;&nbsp;This article attempts to access American and English law&quot;s approaches in interpreting the validity of a charter party contract subject to agreement on the detailed terms on the basis of the general contract law principle, the decision of main term, and the long standing customs of the shipping industry.
