Among definitive countervailing measures imposed by the Community, a proceeding on DRAMs from Korea is more curious because the Community"s measure was challenged by the exporting company as well as the Government of the exporting country, Korea. The WTO panel issued a report on the ED"s countervailing measures on DRAMs from Korea.<BR> The WTO panel published its report on 17 June 2005, although the Hynix case was still pending before the CFI at that time. Therefore the present contribution examines whether the notion of subsidy in the basic Community Regulation and subsidy in WTO law differ in key aspects through the analysis of the Community"s definitive countervailing measure on DRAMs from Korea and the panel report of the WTO.
