우리나라 도선제도에 관한 법제 고찰

A Study on the legal aspects of pilotage system in the Republic of Korea

&nbsp;&nbsp;법률상 우리나라 도선제도의 목적은 우리나라 항만구역, 즉 도선구에서 선박운항의 안전을 도모하고 항만의 효율적인 운영에 기여하는 것이고, 도선사는 이러한 법률상의 목적을 달성하기 위해 도선서비스를 제공한다. 그리고 과거 도선법상에 규정되어진 도선사 재교육은 이러한 목적을 달성하는데 중요한 역할을 담당하고 있었다. 하지만 1999년 이후 우리나라는 규제완화와 실효성의 부족이라는 근거로 도선법상의 재교육에 관한 조항을 삭제하였다. 이것은 도선사의 재교육에 대한 강제성의 부재와 도선사의 재교육 기피라는 문제점을 낳게 되고, 결국 도선구에서의 선박운항의 안전을 제공하기 위한 도선사의 지속적인 자질 향상에 문제점을 초래하였다.<BR>&nbsp;&nbsp;이러한 문제는 도선사의 책임 문제와도 연관되어지게 되는데, 자질이 부족한 도선사가 선박을 운항함으로 도선사고로 이어지게 됨으로, 사고에 대한 책임에 대해 도선사의 업무상 과실책임을 묻게 되는 것이다. 현재 우리나라는 도선사고에 대한 재판이 장기간에 걸쳐 이루어지는 것을 근거로 도선사고에 대한 행정심판 및 민형사상 재판을 함께 진행한다. 이것은 도선사고를 일반 민형사상의 재판과 동일하게 다룸으로 결국 도선사에게 과중한 민형사상 책임을 지우게 되는 문제점을 낳게 한다. 이것은 영국을 비롯한 해운 선진국들이 도선사고에 대해 도선사의 책임을 경감하는 세계적인 추세를 역행하는 것이다.<BR>&nbsp;&nbsp;이에 본고에서는 도선사의 재교육 문제와 민형사상 책임에 대해서 국내외의 규정들을 알아봄으로 우리 도선제도에 대한 법적인 개선방향을 제시하고자 한다.

&nbsp;&nbsp;Maritime pilots play an important role in promoting maritime safety and protecting the marine environment. But international community does not intend to become involved with either the certification or the licensing of pilots or with the systems of pilotage practised in various States because each pilotage area needs highly specialized experience and local knowledge on the part of the pilot.<BR>&nbsp;&nbsp;On this matter the Pilotage Act of the Republic of Korea removed the Article related to re-education system of pilot for mitigation of regulation and lack of effectiveness in 1999. Subsequently, the absence of re-education system causes the problem in continuous developing ability of pilots keeping step with the development of ship&quot;s technology. Moreover, such an inability of pilots concerns with the liability of pilot in case of pilotage accidents of ships specially in relation to the criminal and civil trial process of pilotage accidents.<BR>&nbsp;&nbsp;Thus, this paper considers the legal system for pilot&quot;s re-education and criminal and civil trial process in the Republic of Korea.
