國務總理制의 合理的 運用의 限界와 改憲必要性

&nbsp;&nbsp;The Prime Minister is one of the most familiar state organs to korean people. The korean Prime Minister system has come from 1861 Chinese government, and japanese 1889 Constitution. Also more than 60years has prime minister system sustained.<BR>&nbsp;&nbsp;The Prime Minister has constitutional power to recommend and direct the executive ministers. But the constitutional reality is different. The present Constitution is characterized as ‘Imperial Presidency’, because the President controls excessively the hole state body.<BR>&nbsp;&nbsp;To improve the status of the Prime Minister, it is suggested to divide executive power in President and Prime Minister. But that kind of constitutional interpretation leads false understanding of present presidential system.<BR>&nbsp;&nbsp;The Prime Minister system is suitable to parliamentary system. <BR>&nbsp;&nbsp;According to our constitutional history has the Presidential System brought many incurable problems. The balance of powers did not function well in korean Constitutionalism. Now it is matured, to change governmental system in the Parliamentary Cabinet System.
