유아영재교육 관련법에 대한 문제 연구 - 영재교육진흥법 및 동법 시행령을 중심으로

A study on the problem to related laws for the early gifted children education

&nbsp;&nbsp;교육의 평등주의와 기회균등 원칙 하에서 소외당하고 있는 아동은 장애아뿐만 아니라 뛰어난 잠재적 능력을 소유한 영재아 특히 유아영재들도 있다는 사실이 종종 간과되고 있는 만큼, 그들이 제대로 보호받고 보다 합리적이고 용이하게, 조기에 유아영재가 발굴되어 법적 권리를 인정받아야 한다. 그러나 현행 영재교육진흥법 및 동법 시행령에는 유아영재교육이 배제되어 있어 법적 문제점을 분석해보고, 그 대안을 제시하고 자한다. 이러한 법적 문제점 분석을 유아영재교육측면에서 6가지로 대별된 내용 중심으로 조사ㆍ연구하였다. 즉, 유아영재교육목적 제시, 유아영재특성 및 판별ㆍ진단, 유아영재 연계교육제도, 영재교육기관 교육 내용 및 교육과정, 교원의 임용기준 및 자격, 영재교육진흥 및 선정ㆍ추천ㆍ심사 위원회 구성 등에 관한 것이다. 결론적으로 대별한 내용 외 관련법에서 유아영재교육 내용은 전혀 찾아 볼 수 없었다. 이는 법의 모순으로 판단되며, 이는 유아영재에 대한 역차별화 현상으로 볼 수 있다.<BR>&nbsp;&nbsp;지금부터라도 영재교육진흥법 및 동법시행령에 유아영재교육을 위한 내용을 구체적으로 명시하여 제대로 교육 받을 수 있는 법적ㆍ제도적 보완 및 조치가 절실히 요구된다.

&nbsp;&nbsp;Under principle of equal opportunity in education, the early gifted children having superior potentiality should be fostered from early stage. In order to be, first of all, the foundation of related laws needs to be arranged and then appropriate educational support will be provided.<BR>&nbsp;&nbsp;In this study, there are analysis about the problems of the current education promotion law and suggestion of alternative plan. These problems can be summarized into six parts, that is, &quot;purpose of the early gifted children education&quot;, &quot;early gifted children&quot;s feature, discrimination and diagnosis&quot;, &quot;eatly gifted children&quot;s articulated education&quot;, &quot;contents and curriculum of education institutes for the gifted children&quot;, &quot;teacher&quot;s quality and standard of employment&quot;, &quot;constitution of promotion committee for the gifted children education&quot;.<BR>&nbsp;&nbsp;In conclusion, the clear statement about the early gifted children education in the related laws for the gifted children education is badly needed. Also education experts, teachers, parents and the change of social recognition should be prior.
