UCP 600에서의 서류심사표준에 관한 연구 - UCP 500의 관련규정과 비교하여

Standard for Examination of Documents under UCP 600 - With a Special Reference to Related Rules of UCP 500 -

  This article aims at analysing how the compliance between submitted documents and terms and conditions of the credit would be determined under UCP 600 through in-depth comparison with relevant articles of UCP 500, providing solid foundation for credit practitioners to understand UCP 600. In comparison with UCP 500, this study finds that the rules in UCP 600 with respect to the standard of examination of the presented documents seem to provide better simplicity and clarity to the banks. This analysis is based on the facts that, under UCP 600, ① No mirror image of data is required, ② It introduces the rule that the documents other than the transport documents should be accepted when data content and the issuer are not clearly stated on the credit provided that it fulfills its function, ③ The detailed address of the beneficiary and applicant for the credit is disregarded, ④ The Issuer of transport documents can be a freight forwarder and NVOCC, etc. However, it seems that the provision of UCP 600 relating to non-documentary condition may invite further discussion as it may not be appropriate rule to cover various conditions which may be inserted in the credit.
