2007년 난파물제거협약의 주요내용 및 채택의의

A Study on the Main Issues and Significance of the Convention on the Removal of Wrecks, 2007

&nbsp;&nbsp;국제해사기구는 제63차 법률위원회에서 난파물제거협약 제정의 필요성이 처음 제기된 후 거의 20여년에 거쳐 논의된 결과, 2007년 5월 14일부터 5월 18일까지 케냐의 나이로비에서 협약 채택을 위한 외교회의를 개최하여 2007년 나이로비 국제난파물제거 협약을 채택하였다. 이 협약은 현행 채택되어 발효중인 공해개입협약, 공해개입협약 의정서, 해양사고구조협약 및 민사책임협약과 상충되지 아니하는 범위내에서 난파물의 보고부터 위태의 결정, 난파물의 위치경고 및 표시 그리고 난파물의 제거조치까지 난파물의 신속하고 효과적인 제거를 보장하기 위한 통일화된 국제규칙 및 절차를 마련하였고, 이에 따른 소요비용의 보상이 보장될 수 있도록 강제보험제도를 도입하였다. 마지막으로 이 협약은 분쟁해결과 관련하여 유엔해양법협약 제15장에 따른 강제적인 분쟁해결수단을 도입하였다.<BR>&nbsp;&nbsp;본 논문은 이 협약의 주요내용과 채택의의를 살펴보고, 이 협약을 국내 수용하는 경우 우리나라 해운회사 및 정부가 준비하여야 할 내용을 제시하는 데 그 목적이 있다.

&nbsp;&nbsp;As a result of a long discussion from the 63rd session of Legal committee, International Maritime Organization(IMO) adopted "NAIROBI International Convention on the Removal of Wrecks, 2007" at the Diplomatic Conference which held from 14 to 18 May, 2007 in Nairobi, Kenya. This Convention filled an existing gap in the present maritime law regime such as Intervention Convention 1969 and its Protocol 1973, the Salvage Convention 1989 or Civil Liability Convention(CLC, Nuclear, HNS or Bunker Convention), and made an uniformed international rules and procedures to ensure the prompt and effective removal of wrecks including reporting wrecks, determination of hazard, locating wrecks, marking of wrecks and measures to facilitate the removal of wrecks, and also introduced the compulsory insurance system to secure financial security for the costs of locating, marking and removing the wreck. This Convention finally introduced compulsory procedure for the settlement of disputes as set out in Part XV, Section 2 of the UNCLOS, 1982. This study aims to analyze the main contents and significance of this Convention, and to provide information to be prepared by the shipping company and Government for adopting it into the national maritime law regime because korean merchant ships are to be directly influenced by it.
