한국에서의 전자선화증권의 도입논의에 관한 연구 - 법률적 관점을 중심으로

A Study on the Issues on the Introduction of Electronic Bill of Lading - Laying Stress on the Legal Issues -

&nbsp;&nbsp;UNCITRAL has prepared the new draft Convention on International Transport in order to unify national transport legal systems. This draft deals with electronic transport records, and use and effect of electronic transport records and procedures for use of negotiable electronic transport records and replacement of these and delivery under these records. Australia introduced Sea-Carriage Documents Act 1977 and Carriage of Goods by Sea Regulations 1998 and America prepared Proposed amendments to the US Carriage By Sea Act 1999 and introduced the electronic document of title in the UCC and regulates the transferable records in the Uniform Electronic Transactions Act 1999 and Electronic Signatures in Global and National Commerce Act. Korea revised Maritime Law in Korean Commercial Law Section 5 to govern the Electronic Bill of Lading.<BR>&nbsp;&nbsp;This paper deals with Law and Convention regarding Electronic Bill of Lading and the revised Maritime Law in Korean Commercial Law Section 5 and the purpose of this paper contributes to the streamline the procedures and uses of Electronic Bill of Lading.
