지적데이터의 지적재산권에 대한 인식 분석

An Analysis of Perception for Intellectual Property Rights of Cadastral Data

&nbsp;&nbsp;지적데이터가 기초지방자치단체에 구축되고 많은 예산과 인력을 투입하여 유지ㆍ관리 되고 있으며, 이를 기본도로 이용한 GIS의 구축이 활성화 되고 있다. 지적데이터 특성상 공공재로서 인식과 비교적 간단하게 복제되어 활용할 수 있는 특성 때문에 공식인증 되지 않은 지적데이터의 불법유통 등 많은 문제점이 발생되고 있으나, 이에 대한 연구가 충분히 되고 있지 않다.<BR>&nbsp;&nbsp;본 연구에서는 지적데이터의 지적재산권의 대하여 이해당사자인 지방자치단체의 생산자와 이를 활용하는 이용자의 인식을 조사ㆍ분석하여 지적데이터의 지적재산권 보호와 유통방안을 연구 하는데 기초자료로 제공하고자 하였다. 이해당사자의 인식을 조사ㆍ분석한 결과 지적재산권 보호에 대하여 당사자 모두 인정하는 것으로 조사 되었으며, 인정 이유로는 유통에 따르는 분쟁방지 및 데이터의 유지보수를 위하여 보호되어야 한다고 조사되었다.

&nbsp;&nbsp;Cadastral database is build by base local governments and maintained by lots of budget and manpower. GIS is made by using basic map based on cadastral database. Since cadastral database is recognized as public materials and it is easily copied and used, non-registered cadastral data is illegally distributed. However there are few researches and studies related to this matter.<BR>&nbsp;&nbsp;This study examines and analyzes interested parties&quot; acknowledgement on intellectual property right on this cadastral data, especially local government who produces the cadastral data, and users who utilize the data, to make it as an underlying data for the study on how to protect intellectual property right of cadastral data and distribute them. As a result of examination and analysis on the interested parties&quot; acknowledgement, they all agree with the idea that the intellectual property right should be protected, and they cited preventing dispute caused by distribution and maintaining data as main reasons of the agreement.
