외국의 중ㆍ고등학교 규칙 내용 분석의 시사점

&nbsp;&nbsp;우리나라 학교생활규칙은 두발 및 복장에 대한 규제 및 집회ㆍ결사의 제한으로 학생들의 자유권을 침해하고, 징계시 절차상의 미비로 학생들의 보호 복지권을 보장하지 못하는 등 인권 침해적 요소를 담고 있다. 이에 비해 미국, 캐나다, 호주, 중국, 대만, 일본 등 다른 나라의 경우, 중ㆍ고등학교 규칙들은 어떤 요소들을 담고 있는지를 비교분석하므로써, 외국 사례의 특징들을 추출하고, 앞으로 우리나라 학교생활규칙의 개선 방향에 대한 시사점을 얻고자 하였다.<BR>&nbsp;&nbsp;외국의 학교생활규칙 내용 분석 결과, 학교생활규칙의 구성 요소는 분석 국가별로 별다른 차이를 보이지 않았다는 점과 두발 및 복장 규제로 인한 학생들의 인권 침해적 요소가 우리나라의 경우에만 나타나는 것은 아니라는 점에서는 유사점을 보였다. 그러나 각 나라마다 정치, 사회, 문화적 특성에 따른 요소들을 반영하고 있었으며, 우리나라 학교생활규칙들에 비해 상세하다는 특색을 띠고 있다. 따라서 학생 인권의 보장을 위해서 처벌에 대한 기준과 징계시 소명 절차를 포함 학교생활규칙의 상세화, 더 나아가 체벌의 금지, 학교생활규칙 자율 제정 방안 등이 이루어져야 한다고 본다.

On this opposite, this thesis tried to abstract the feature of cases of foreign countries, and to get the suggestion of an improvement direction that korea middle and high school regulations have in it by using to compare and analyze of facts that the middle and high school regulations are included.<BR>&nbsp;&nbsp;According to analysis of the school regulation, the next points of similarity were showed. These are that the school regulations contents didn&quot;t show particular difference between analysis countries and that the human&quot;s rights infringement elements that was result by regulating of the student&quot;s hair and dress appear not only our country but also another countries. But another country&quot;s school regulations reflected of their political, social, cultural characters and elements, and it more detail than our country&quot;s school regulations. For the guarantee of student&quot;s human rights&quot; many elements they are a standard of punishment, an explanation process in punishment, the details of the school regulation, a prohibition of punishment, the school regulations&quot; self-imposed control plan should have been realized.
