Guarantee System of Commodity Quality and Consumer Protection

&nbsp;&nbsp;오늘날 급속도로 진행되고 있는 기술혁신과 지속적인 경제성장에 힘입어 복잡하고 다양한 기능을 가진 상품이 새로운 모델로 시장에 등장하여 소비자의 구매 욕구를 높이고 있다.<BR>&nbsp;&nbsp;그런데 이러한 신제품의 출현은 소비생활에의 편리와 만족을 주고 있지만, 사업자 특히 제조자의 성급하고 무리한 상품개발로 인한 품질, 기능, 안전성에 대한 주의의무를 다하지 않음으로써 소비자피해의 절대적 요인으로 작용하고 있다. 한편 소비자는 상품을 구매할 때 통상 상품에 ‘기대하는 품질’과 ‘가격’을 함께 고려하여 선택한다. 특히 상품의 품질에 대한 소비자의 신뢰보호가 바로 품질보증의 문제라 할 수 있다. 이러한 소비자의 신뢰보호와 관련하여 문제가 되는 것으로는 1) 소비자의 신체, 재산에 위해를 끼칠 우려가 있는 유해한 상품은 배제되어야 한다는 것을 들 수 있다. 즉, 소비자는 상품이 시장에서 판매되고 있는 이상 그것이 유해하지는 않을 것이라는 기대를 가지는 것은 당연하고, 이러한 기대는 상품에 대한 소비자신뢰의 가장 기본적인 내용이다. 2) 소비자는 상품의 품질에 관하여 정확한 정보를 충분히 제공받아야 한다는 것이다. 즉, 소비자가 적정하게 상품을 선택할 수 있다는 것을 의미한다. 이러한 소비자의 적정한 상품선택을 보장하기 위해서는 정보제공이 정확하고 충분하게 이뤄져야 한다.<BR>&nbsp;&nbsp;3) 구매한 상품의 하자로 인하여 소비자가 입은 손해 중에서 상품의 가치 감소에 대한 사업자의 책임문제를 들 수 있다. 4) 상품의 안전성과 관련하여 볼 때, 상품의 결함으로 인하여 소비자가 생명ㆍ신체ㆍ재산상 훼손을 입은 경우에 그 상품의 제조자나 판매자에게 손해배상책임을 지우는 ‘제조물책임의 문제를 들 수 있다. 이와 같은 품질에 대한 소비자의 신뢰와 관계있는 다양한 분야 중, 소비자가 구입한 상품의 하자로 인하여 통상의 구매에서 기대되는 품질, 기능, 내구성의 결여로 인한 손해 중 제품 자체의 피해에 대하여 사업자에게 하자보수(수리), 교환 등 어떠한 내용의 책임을 부담시킬 것인가 히는 경우만을 본고에서 논하는 ’품질보증책임의 문제’로 한정지었다.<BR>&nbsp;&nbsp;특히 내구성 소비재상품의 품질, 성능에 대한 소비자인식이 높아져 품질보증과 관련한 소비자불만이 높아지고 있다. 즉 소비자로서는 내구소비재가 비교적 고가상품이기 때문에 장기간에 걸쳐서 내구성을 향유하기를 기대하지만, 구입한 상품으로부터 만족을 얻지 못함은 물론 손해를 입는 경우가 많기 때문에, 소비자의 권익을 보호하기 위한 적정한 피해보상방안이 요구된다.<BR>&nbsp;&nbsp;이에 본고에서는 현행 품질보증 제도의 개선방안을 강구하고자 국내외의 각종 문헌을 활용한 이론적 분석을 통해 제 2절에서 구체적인 품질보증의 본질을 밝히기 위해, 품질의 개념, 품질보증의 의의, 품질보증의 효과 등을 규명하였고, 제3절에서, 먼저 사법상의 품질의 개념과 품질보증책임의 법적 구조를 규명한 후 현행 관련법제도 및 품질보증 실태분석을 통한 우리나라 품질보증제의 현황을 고찰했고 제4절에서 미국, 영국, 독일, 일본 등 선진국의 품질보증제도와 품질보증 책임의 법리 등을 고찰해 본다.

Along with the development of socialist market economy, the consumer problem is mote and more important. The theory of protection consumer rights is more and more paid attention for the people. At market economy system, too many law scholars had made a great contribution to the research for protecting the consumer rights which is faced to the new situation and question.<BR>&nbsp;&nbsp;At first, it would mean the new enhancement of construction of consumer rights theory. Presently, the importance and the interest of people to the consumer rights theory is not already simple aspect of Infringement phenomenon or protective management, but is how to participate actively inthe socialist market economy movement track as a market partner. But the category of the consumer protection is not too vast ar the real market life, becauseof the much supply and over-flow of products and services at real market and the lack of professional knowledge of that. In additional, the new consumer contract has been made due to the era of information and electronic. So, we need retry to examine and fix the current consumer protection problem and to investigate the aim of it., And for the equal distribution in the process of increasing life level, and it is because of equal life level of people due to the development of transmission and telecommunication.<BR>&nbsp;&nbsp;This paper entitled "guarantee system of commodity quality and consumer protection", through analyses the quality concept, inspected the quality guarantee responsibility legal structure and through analyses quality guarantee system of the South Korea, US, England, Germany and Japan, inspected the situation of the consumer protection and product quality guarantee.
