A Study on the Present Situation and Problems of the Compensation System in China

&nbsp;&nbsp;1. CONTENTS<BR>&nbsp;&nbsp;(1) RESEARCH OBJECTIVES<BR>&nbsp;&nbsp;This paper analyzes the China&quot;s compensation system. China does not have reasonable land compensation principle, while most countries have just terms compensation principle when they expropriate some land for the public interest. China has only some regulations stipulating that the acquiring authority must provide suitable compensation to the dispossed people, but it does not make it clear what suitable compensation is and how it should be decided. This paper aims to study on the present situation and problems of the compensation system in China.<BR>&nbsp;&nbsp;(2) RESEARCH METHOD<BR>&nbsp;&nbsp;Literature research.<BR>&nbsp;&nbsp;(3) RESEARCH RESULTS<BR>&nbsp;&nbsp;China&quot;s compensation standard has been operated ambiguously and unscientifically. For example, there is a wide gap between the maximum and the minimum value in compensation standards for arable land. Also there is a great disparity of the average annual production value computed by the government and by the committee of the farmers. Also the recipients of the land compensation in China are not the farmers but the collective. Chinese farmers are only given the compensation for the improvements and crops on the earth, and the relocation costs and settlement subsidy, but they cannot get any compensation for the others.<BR>&nbsp;&nbsp;2. RESULTS<BR>&nbsp;&nbsp;China&quot;s compensation system is characterized by the lack of just terms compensation, delay in payment of compensation, no concept of interest in land, no compensation to living rights. This paper at tempts to clarify the problems of China&quot;s compensation system. It will be very useful to Korean investors in China.
