회복적 사법제도 고찰을 통한 교정복지 개선방안

Improvement program of correction and welfare through investigation of recovery judicial system

  교정복지 시설은 교정이념을 실행하는 곳으로 “범죄자를 사회로부터 격리 구금하고 그 범죄성을 교정하여 건전한 시민으로 재사회화하기 위하여 교육, 교화하는 장이라고 할 수 있다. 즉, 현대 교정복지 시설의 궁극적인 역할은 회복적 사법을 통한 수용자를 재사회화하여 일상적인 생활로 사회복귀를 하는데 있어 교정복지 수용시설이 중요한 역할을 한다. 따라서 본 연구는 회복적 사법제도 고찰을 통하여 교정복지 개선방안에 관한 연구를 통하여 다음과 같은 연구결과를 얻을 수 있었다. 첫째, 교정 복지수용시설은 단일 시설 내에서도 수용 동을 세분화 하여 수용자별 특성에 부합하는 처우가 가능하도록 하여야 할 것이다. 둘째, 보안위주의 수용자 복지시설을 해야 할 것이다. 즉, 수용자의 분류에 의해 특성을 감안하여 보안등급을 결정하여 수용자의 사회적응을 도모하기 위해 건전한 연간관계 형성 및 사회 환경 적응을 할 수 있도록 개선해야 할 것이다. 수용자의 교정시설 내 구금생활을 통하여 교정교화 되어, 사회일원으로서 재사회화시키기 위해서는 우선 수용자가 시설 생활에 잘 적응하여야 하며, 수용자간 그리고 수용자와 직원 간 인간관계가 형성될 수 있는 시설 환경이 조성되어야 한다.

&nbsp;&nbsp;Since the correction and welfare facilities are place to implement corrective idea, it can be said to be the forum to separate and confine criminals from society and to educate/ cultivate them to restore to sound citizen by correcting the criminal property. Namely, the ultimate role of modern correction and welfare facilities are important to make termer restore to normal life in the society through recovery judicial system. Thus, this research acquired the following results through recovery judicial system and study on the improvement program of correction and welfare.<BR>&nbsp;&nbsp;First, it is required to subdivide accommodation buildings in the same accommodation facilities of correction and welfare so that the termer can be treated properly to their property.<BR>&nbsp;&nbsp;Second, the termer welfare facilities for security are necessary. Namely, it is required to improve so as to form sound human relation and adapt to social environment so that termer can adapt to the society, considering the property of termer as per classification and deciding their security grade.<BR>&nbsp;&nbsp;To correct and cultivate termer in the confinement of corrective facilities for returning to society as a member, it is essential to construct facilities environment where termer can easily adapt and the human relation can be well formed among termers as well as between termers and staffs.
