The copyright law of Korea is ruling that the moral rights are inalienable in article 14, clause 1. That rule is common among many countries" law, and the courts and scholars of Korea take it as granted.
That rule, however, has conflicts with article 9, which rules about employed authors. Unless we think the moral rights are alienable, we can"t explain the exact meaning of article 9.
Each rights which belong to the moral rights are the similar conflicts with article 14, clause 1. For example, the right of making public in article 11 of legal entity can"t exist unless moral rights are alienable.
To explain the copyright law of Korea in harmonious way, we need to doubt the inalienability of moral rights. If needed we should make some exceptions to the inalienability of moral rights.
There already have been some questioning of whether the moral rights are inalienable, and some countries made some exceptions to the inalienability of moral rights.
From now, we need to study the inalienability of moral rights with open mind to keep the copyright law pace with real world and to accomplish the goal of copyright law.
