이상심리 범죄자의 재범방지에 관한 형사사법적 고찰 - 판결전 조사제도를 중심으로

A Study on the Prevention of Second Offense which committed by Psychologically Abnormal Criminals

  사회의 급속한 발전과 환경의 변화에 따라 정신병까지는 아니더라도 심리적으로 문제를 가진 사람들이 늘어가고 있는 추세이다. 실제로 판결전조사를 위해 피고인들을 면담하는 과정에서 이들에게 비정상적인 심리상태가 있음을 발견할 수 있고, 이것이 범죄에도 영향을 미쳤음을 추측해 볼 수 있다. 중요한 사실은 이들이 과거에도 동종 또는 이종의 전과가 있었으나, 벌금이나 단순집행유예로 풀려나거나 징역을 선고받았을 뿐 심리적 개입이 취해지지 않았다는 점이다. 본 논문에서는 이들을 그대로 사회에 방치할 경우 파생되는 사회적인 피해와 개인적인 손실을 막기 위해서 국가가 형사사법적 개입과 심리적인 개입을 병행해야 할 필요성이 있음을 강조하고자 한다. 본 논문에서는 보호관찰관으로서 ‘판결전조사’를 수행하면서 발견되었던 이상심리 범죄자들의 4가지 사례를 소개하고, 이들의 재범을 예방하기 위해 형사정책적으로 개선되어야 할 과제를 제안하고자 한다. 판결전조사 사례는 ① 취중에 자신의 어머니를 칼로 찌른 존속상해 사례, ② 상습적으로 공짜술을 마시고 택시에 무임승차한 상습사기 사례, ③ 여자속옷을 습관적으로 훔쳐온 상습절도 사례, ④ 교도소에서 동료수형자를 폭행하고, 법정에서 난동을 부린 사례 등이다.

&nbsp;&nbsp;There are not a few people in the community that have some psychologicalproblems as well as psychosis. <BR>&nbsp;&nbsp;In the process of presentence investigation counselling, we can find that there are some criminals that have psychologically abnormal conditions and this had influenced the crime.<BR>&nbsp;&nbsp;We must pay attention to the fact that they have had the same or other criminal record, but they had been released to the community on the condition that they pay a fine, or they had been sentenced to some months in jail with a stay of execution for some years without probation officer&quot;s supervision, or they had been sentenced to some months in jail without any psychological therapy.<BR>&nbsp;&nbsp;In this article, I emphasis on the need of criminal justice system&quot;s psychological intervention by which we can prevent the social and individual damage that can occurred in case of leaving the criminal alone in the community without any control or supervision.<BR>&nbsp;&nbsp;I introduce four major case of the psychologically abnormal criminals that have been founded in the presentence investigation process. And I propose the solutions to be needed.<BR>&nbsp;&nbsp;The samples of presentence investigation are ①The accident of injury that someone stabbed his mother with a kitchen knife under the influence of drink, ② The accident that someone habitually drink alcohol and take a taxi without money, ③The accident that someone habitually steal women&quot;s panties and brassieres, ④ The accident that someone did violence to his colleague in prison and made a disturbance in the court.
