&nbsp;&nbsp;우리 사회에서 집회 및 시위는 다중이 모여 평화적인 방법으로 집단의 의사나 요구를 표명하는 ‘의사표현의 한 방법’으로서보다는 무질서ㆍ폭력사태ㆍ사회불안의 상징으로 자리잡고 있다.<BR>&nbsp;&nbsp;이로 인한 불법폭력시위로 국민과 경찰관이 부상을 당하는 일이 빈발하고 있으며, 장소 선점을 위한 위장집회가 크게 늘어났다. 그래서 정작 집회 및 시위를 필요로 하는 당사자들의 집회 및 시위 자유권을 제한하는 것은 물론 불필요한 경찰력 동원에 따른 치안력을 낭비시키는 요인이 되고 있다.<BR>&nbsp;&nbsp;하지만 준법집회의 자율적 관리와 평화적 집회 및 시위 문화 정착을 위한 부단한 노력으로 화염병ㆍ쇠파이프를 이 용한 폭력집회가 대폭 감소하는 등 집회 및 시위 문화의 평화적 진전추세가 확산되었다. 이에 따라 경찰은 사회질서유지는 물론 경제안정ㆍ대외신인도 확보를 위해 국민의 준법집회는 한층 더 보호하고 국민 불안을 초래하는 불법 폭력시위는 단호히 대처함으로써 평화적인 집회 및 시위 기조를 유지하기 위해 최선의 노력을 기울였다.<BR>&nbsp;&nbsp;그 결과 국민의 의식변화와 건전한 집회 및 시위 문화의 확산으로 불법 폭력시위는 2004년에 비해 크게 감소하였고, 이에 따른 부상자와 투입된 경찰인력도 함께 감소하였다.<BR>&nbsp;&nbsp;하지만 집회 및 시위로 인한 폭력사태ㆍ인권침해를 경험하지 않고 평화로운 집회 및 시위문화 정착을 위한 노력이 중요하다.<BR>&nbsp;&nbsp;이에 연구자는 경찰의 입장에서 집회 및 시위 대응실태와 그에 대한 개선방안에 대해서 연구하였다. 연구결과 그 방안으로 다음과 같이 정리할 수 있다.<BR>&nbsp;&nbsp;첫째, 집회 및 시위를 신고단계 그리고 현장관리단계 등으로 나누어 단체별 그리고 유형별로 관리하고 관리기법을 계발하여야 한다.<BR>&nbsp;&nbsp;둘째, 민간안전요원의 배치 등 집회시위주최자들이 불법폭력시위 등에 대한 자체예방대책을 강화해야 한다.<BR>&nbsp;&nbsp;셋째, 현행 집회 및 시위에 대한 신고제보다 영국이나 미국의 집회 및 시위에 대한 조건부허가제를 경찰에 도입하여야 한다.<BR>&nbsp;&nbsp;마지막으로 Police Line 위반자에 대한 형사적 처벌강화와 손해배상 책임과 원상회복책임 등 민사적 손해배상 청구 등의 엄격한 법집행을 제시하였다.

&nbsp;&nbsp;In our society, the assembly and demonstration is considered as the symbol of disorder, violence and social unrest rather than &quot;the one method of peacefully expressing&quot; the intention and request of the group by gathering.<BR>&nbsp;&nbsp;Furthermore people and police are injured frequently because of the illegal violent demonstration, and the disguise assembly to preoccupy the place has been increased a lot. So, this leads to the restriction of the liberty of the assembly and demonstration of the people who really need it and the abuse of the public security by unnecessarily mobilizing the police.<BR>&nbsp;&nbsp;However, in an effort to settle the autonomous management of the law-abiding assembly and the peaceful culture of the assembly and demonstration, the violent assembly has decreased a lot to make the air of peaceful culture of the assembly and demonstration. Accordingly, the police did their best to maintain the peaceful air of assembly and demonstration by protecting the law-abiding assembly and suppressing the illegal violent demonstration.<BR>&nbsp;&nbsp;As a result, not only the number of illegal violent demonstration but also the number of the casualty and the police has been decreased a lot than that of 2004 because of the consciousness change and the spread of the desirable culture of the assembly and de monstra tion.<BR>&nbsp;&nbsp;However, it is important to make an effort to settle the peaceful culture of the assembly and demonstration not experiencing the violence and the encroachment of rights.<BR>&nbsp;&nbsp;The researcher has studied the encounter for the assembly and demonstration and the method of improvement with the view of the police. And he &quot;NiH summarize as follows.<BR>&nbsp;&nbsp;First of all, we should analyze the assembly and demonstration by the stage of report and the manage of the sight, and develop the way of management by the stage and the patterns.<BR>&nbsp;&nbsp;Second but not least, we should introduce the conditional license system of England and America rather than the report of the assembly and demonstration.<BR>&nbsp;&nbsp;Finally, the researcher suggests the strict execution of the law like the enforcement of the criminal punishment, damage compensation, and restoration of the status quo about police line violators.<BR>&nbsp;&nbsp;Above all, the police should do their basic duty not to repeatedly execute the wrongly execution of the law and consciousness.
