민간조사원 자격요건에 관한 연구

&nbsp;&nbsp;단순 대행 업무를 중심으로 시작되었던 ‘심부름 센터’는 그 본질적인 목적에서 벗어나 개인 정보 유출, 도청 등의 사생활 침해뿐만 아니라, 청부살인, 협박 등 각종 범죄를 자행하여 사회적인 문제로 부각되는 실정에 이르렀다. 이에 무분별하게 난립하고 있는 ‘심부름 센터’를 법률로서 해당 업무를 분장하고 지속적인 관리와 감독함과 아울러 경찰력만으로는 국민들의 치안수요를 감당하기 어려운 이 시점에 음성화 되어 있는 심부름 센터와 관련된 직종을 합법적 시스템으로 양성화할 수 있는 방안으로서 민간조사원 제도가 도입되기 이르렀다.<BR>&nbsp;&nbsp;그러나 민간조사원의 업무가 ‘심부름센터’ 등의 단순한 업무가 아니라 또한 일반적인 자격증과는 달리 고도의 전문성과 도덕성을 요하는 업무와 국민의 생명ㆍ신체ㆍ재산의 보호와 관련된 것이 많기 때문에 자격 요건에 있어서 응시자격 내지 자격 요건을 엄격히 제한해야 한다는 것이 전반적인 견해이다. 따라서 본 연구에서는 이에 민간조사원의 자격 요건이 다른 어떤 자격 제도 보다 더욱 엄격한 결격사유와 자격 요건이 필요한 것이라는 전제하에 국내의 대표 자격 제도인 법무사, 공인노무사, 관세사, 공인회계사의 응시 자격 등의 요건에 대해 아울러 Z005년 민간조사법안의 발의와 관련 이상배 의원의 법안과 최재천 의원의 법안의 내용을 검토하여 향 후 민간조사원 자격 제도의 요건에 대해 논해보고자 한다.
