민간조사법 법안의 주요 쟁점에 관한 연구 - 이상배ㆍ최재천 안을 중심으로

&nbsp;&nbsp;그 동안 우리사회는 심부름센터나 흥신소의 폐해 때문에 민간조사시장이 활성화될 여지가 별로 없었다. 이런 상황에서 근자에 관련업계의 로비와 관심 있는 국회의원들의 입법발의에 힘입어 민간조사업 법안이 국회에 제출된 것은 무척 다행스런 일이라 생각된다. 만약 이 법 안이 통과된다면 음성화된 민간조사시장의 폐해를 극복하고 우리도 자랑스러운 명탐정을 갖게 될 수 있을 것이란 기대가 앞선다. 이런 기대를 하는 것은 명탐정들이 공식수사기관이 갖는 한계와 공백을 메울 수 있기 때문이다. 또 다국적 로펌이나 외국계 민간조사회사들의 공격적인 마케팅 때 맞설 수 있기 때문이다.<BR>&nbsp;&nbsp;이런 기대 속에 필자는 지금까지 민간조사법안의 주요 쟁점인 업무범위, 자격과 자격시험 및 감독과 관련하여 두 법안의 관련 규정을 적시하고, 이를 비교하였으며, 관련문제들을 두루 살펴보고 각각의 쟁점에 대해 필자의 견해를 피력한 바 있다. 이를 간단히 요악하면 다음과 같다.<BR>&nbsp;&nbsp;먼저, 업무범위는 ‘최안’처럼 보다 세분하여 민간조사업이 해당 전문 분야의 회사로 성장할 수 있도록 유도하는 것이 좋을 것으로 판단된다. 이는 선진 외국의 민간조사업이 특정분야에 주력하여 세계시장을 개척하고 있다는 점을 강조한 것이다.<BR>&nbsp;&nbsp;다음으로, 자격시험은 폐쇄적으로 운영되는 것보다는 이 분야에 관심있는 많은 젊은이들이 진입할 수 있도록 문호를 개방하는 것이 좋을 것으로 생각된다. 문호를 개방한다 하더라도 민간조사시장은 철저한 자유 경쟁체제이기 때문에 능력이 없는 민간조사원은 발을 붙이기 어렵기 때문이다.<BR>&nbsp;&nbsp;마지막으로, 감독은 경찰청장이 하되 민간조사원(업)의 관리문제는 업체의 자율을 강조하기 위해 민간조사협회가 맡는 것이 타당할 것으로 생각된다.
