직접행동민주주의와 헌정수호 - 최근의 정치상황에 관한 이론적 성찰

Direct Action Democracy and the Protection of Constitutional Politics: A Theoretical Reflection on the Political Context of Korea in 2008

  이 글은 2008년 7월 10일 현재 계속되고 있는 촛불집회를 헌법이론의 관점에서 분석해보려는 시도이다. 촛불집회에 관하여 극단적으로 엇갈리는 긍정과 부정의 두 입장을 넘어서기 위하여 초점으로 삼은 것은 직접행동민주주의와 헌정수호의 문제다. 2008년 여름의 한국 사회에서 직접행동민주주의가 발현될 수밖에 없는 가장 큰 이유는 몇 차례의 선거과정에서 축적된 대의민주주의의 위기 때문이다. 역대 최저의 투표율, 정당정치의 현저한 약화, 공적 정치과정이 아니라 사적 거래과정으로 전락한 선거, 선출된 대표들의 능력 바깥에서 삶의 영역을 직접적으로 진공해 들어오는 글로벌 이슈들, 무능할 뿐 아니라 권력 독점에 여념이 없는 선출된 대표들, 거기다가 지리멸렬한 야당, 다음 번 선거까지는 아무 것도 할 수 없을지 모른다는 무력감 등을 극복하기 위하여 헌법의 주어인 대한국민은 직접적인 행동을 통해 자신들의 존재를 드러내고 있다. 이 점에서 촛불집회는 직접적인 헌정참여의 형태로 대한국민의 헌정권력이 발현되는 헌법적 현장으로서의 의미를 가진다. 따라서 헌정수호는 반드시 이와 같은 헌정권력을 대의민주주의의 갱신을 위한 동력으로 이끄는 방향에서 기획되어야 한다. 이를 부인하고 대의민주주의 체제 그 자체를 수호하는 것을 헌정수호라고 강변하다가는 자칫 거짓 헌정수호 또는 헌법침해를 정당화할 가능성이 없지 않다. 또한 신자유주의적인 사회 자체의 재구성이 심화되는 현실 속에서 직접행동민주주의와 대의민주주의의 관계설정에도 많은 고민과 토론이 필요하다.

  This article aims to present a theoretical understanding about the political struggles which had overwhelmed the main streets and squares of Seoul under the title of “Candle Demonstration” from May to July of 2008 in Korea. Being apart from the polemics on the candle demonstration in real political arena, the author starts with a kind of investigation upon the representation system of Korean politics. There were many signs that showed the political representation system was getting weaker and wrong-headed, for example low late of vote in election and the malfunction of party politics. The author wants to theorize the candle demonstration as a kind of direct action democracy in the relationship with the crisis of representative democracy, because there were many interesting and moving features in the streets and squares showing that the Korean Nation, the subject of Korean Constitution, were revealing their “Constituent Power.” Hence, the author tries to grasp this direct action democracy as a kind of fountain of energy which can reform and renew the representative democracy. It is very unreasonable for him to regard the direct action democracy as an enemy of representative democracy.
