독일 대학법의 개혁에 관한 연구

A study on the reform of German Higher Education Laws

&nbsp;&nbsp;1970년대를 거쳐 1990년대 초까지의 독일 대학법의 기본 틀은 소위 ‘정교수대학(Ordinarienuniversit？t)’에서부터 소위 ‘집단관리대학(Gruppenuniversit？t)’으로의 형태였다고 할 것이다. 그런데 1990년대 말부터는 유럽연합이라고 하는 유럽통합의 과정과 대학교육의 효율성 및 국제경쟁력 제고라고 하는 대내외적 요인들로 인하여 대학참사회(Hochschulrat) 내지는 대학재단이사회(Stiftungsrat) 중심의 소위 ‘이(참)사회대학(R？teuniversit？t)’으로의 변화와 대학개혁으로 이어졌다. 1990년 대말부터 현재까지 이러한 독일 대학개혁의 법제적 중심에는 독일 대학기본법(Hochschulrahmengesetz)과 독일 각주의 대학법(Hochschulgesetz)들이 있다. 그리고 이런 주의 대학법 중에서 특히 Niedersachsen주의 대학법이 특별한 의미를 가지고 있다.<BR>&nbsp;&nbsp;최근 10년간 독일대학법 개정의 두드러진 특징은, 첫째, 대학기본법상의 규제철폐와 각 주의 자율적 입법형성권이 확대되어졌다. 둘째, 대학의 법적 지위에 관한 규정 개정으로 기존의 공법상 사단이자 국가 시설물로서의 법적 지위를 유지할 수 있을 뿐만 아니라 재단법인과 같은 특수한 형태로 국립대학들이 전환될 수 있게 되었다. 셋째, 유럽통합과 함께 “Bachelor”와 “Master” 학위제 및 대학평가제도 도입과 같은 국제적 기준에 맞는 대학영역에서의 제도적 통일 노력이 대학법에 반영되고 있다. 넷째, 2006년 독일 연방제도 개혁으로 인하여 대학기본법의 폐지가 예견됨으로써 이전보다 주의 대학 영역에서의 기능강화와 대학자율성 확대가 예상된다.

&nbsp;&nbsp;In Germany responsibility for the education system is determined by the federal structure of the state. Under the Basic Law (Grundgesetz) the exercise of governmental powers and the fulfillment of governmental responsibility is incumbent upon the individual states(L？nder) as far as the Basic Law does not provide for or allow for any other arrangement.<BR>&nbsp;&nbsp;In the German Higher Education Law system, fundamental changes are currently being implemented under which special importance is attached to the various efforts for more autonomy and quality assurance. In the higher education area, extensive reforms have also been introduced in Germany for modernization, globalization and quality assurance in the last few years. It requires consideration about the provisions of the german statutes about the legal status of university and the governance of university.<BR>&nbsp;&nbsp;The German Federal Reform in 2006 transferred frame legislative powers in higher education from the Federation to the States. Is the German university going on Boards-university from Professors-university via Groups-university? For the answer we should watch the evolution of the German higher education laws.
