자동차 보험범죄에 관한 소고

A Study on Vehicle Insurance Crime

&nbsp;&nbsp;최근의 보험범죄의 추세를 살펴보면 과거의 단순 사기형이나 생계유지를 위한 생계형 보험범죄의 형태가 점차 전문브로커나 폭력조직 등에 의한 범죄로 점차 조직화ㆍ기업화되면서 적발된 보험금액도 높아가고 있는 실정이다. 최근에는 자해 공갈단이나 보험금 사취를 목적으로 처ㆍ자식을 볼모로 하는 반인륜적인 보험범죄의 등장, 심지어 채무관계를 악용하여 자살을 교사하는 등의 극단적이고 한탕주의적인 범죄로까지 이르게 되었다.<BR>&nbsp;&nbsp;이러한 보험범죄를 통한 보험금의 부정유출은 보험사의 손해율을 악화시키고 보험료의 인상을 초래하여 결국 가입자 및 시민들에게 경제적 부담 및 육체적ㆍ정신적 피해를 초래함은 물론 사회전반에 걸쳐 불신감을 조장하여 사회윤리 및 가치관의 붕괴 등 사회전체의 문제로까지 확대될 수 있다는 점에서 보험범죄를 예방하고 이에 대한 대책이 수립되어야 한다는 필요성에 따라 본 연구에서는 자동차를 이용한 보험범죄의 실태 및 문제점을 살펴 이를 토대로 자동차보험범죄에 대한 효율적인 대응방안을 살펴보고자 한다.

&nbsp;&nbsp;Almost all casualty insurance companies have suffered losses in underwriting crime insurance. most insurance companies have taken drastic steps to counter this trend. they have canceled or refused to renew policies of insurees who have suffered losses from criminal activity, limited allowable coverage to a point well below replacement or even cash value of goods or property, limited the extent of coverage, set up limitations that exclude businesses in high-crime areas or in high-risk enterprises from any coverage at all, and increased premium rates.<BR>&nbsp;&nbsp;It is virtually impossible to insure against all the losses that could be incurred. hidden damages in loss of company morale and customer confidence and in interruption of vigorous participation in a highly competitive market-these are serious, if not fatal, blows to any business and can never be recompensed.<BR>&nbsp;&nbsp;Clearly insurance can never be a substitute for a security program. in many cases, the very fact that assets are insured to some degree tends to reduce the interest of the proprietor in instituting reasonable security procedures beyond those minimums specified in a policy. as an aspect of the overall picture, insurance tends also to reduce any interest the insured may have in capturing or prosecuting perpetrators of crimes, thus in effect encouraging the proliferation of like crimes.
