항공우주산업의 외화획득용 수입승인제도 개선연구 - 대외무역법규 개정방안을 중심으로

A Study of the Improvements of Import Approval System of Raw Material for Acquisition of Foreign Currencies in Aerospace Industry

&nbsp;&nbsp;본 연구는 문헌연구와 심층면접조사 결과를 근거로 외화획득용 수입승인제도의 개선방안과 대외무역법규 개정방안을 제안하였다. 제도개선을 위한 3가지 방안은 첫째, 동 제도를 민간수입업자들에게 실질적인 혜택을 주는 방향으로 대외무역법 제16조 제1항의 내용을 현실적으로 수정하는 것이고 둘째, 동 제도를 개선하는 방안이 불가능할 경우, 동 제도를 폐지하는 방안이며 셋째, 동 제도의 폐지에 따른 수출지원제도의 축소에 대하여 구매확인서 제도를 보다 더 활성화시킴으로써 그 공백을 보완하는 방안이다.<BR>&nbsp;&nbsp;제도개선에 따른 법규개정 방안은 첫째, 동 제도를 개선할 경우, 대외무역법 제16조 제1항의 내용에서 “제11조 제4항”을 “제11조 2항”으로 수정해야 하는 것이고 둘째, 동 제도를 폐지할 경우, 대외무역법 제16조 내지 제17조와 동법 시행령 제24조 내지 제30조, 관리 규정 제31 내지 제53조, 제59조 내지 제69조를 모두 삭제하여, 위임 및 위탁관계에 대한 조문을 정리하는 것이며 셋째, 구매확인서 제도와 관련된 관리규정 제36조와 제37조를 보완하여 절차간소화 및 발급기관을 확대하는 것이다.

&nbsp;&nbsp;This study suggested improvement plan of import diversification for acquisition of foreign currencies and suggested foreign trade legislation revision plan. First of all, the improvement plan will have to be proceeded through method of improvement, abrogation, repletion of purchase confirmation system.<BR>&nbsp;&nbsp;First, government corrects contents of Foreign Trade Act. article 16 the first clause actually to give importers real benefit. Secondly, if improvement of this system is impossible, government will have to abrogate this system. Third, government will have to supplement blank by activating purchase confirmation system more for reduction of export support system by abrogation of this system.<BR>&nbsp;&nbsp;Next, according to improvement plan, plans that revise Foreign Trade Act. are as following. First, in the case of system improvement, in Foreign Trade Act. article 161 clause, "Article 11.4 clauses" should be modified as "Article 11.2 clauses". Secondly, in the case of system abrogation, Foreign Trade Act. article 16 ~ article 17 and enforcement ordinance article 24 ~ article 30, government official regulation 31 ~ article 53, article 59 ~ article 69 all erase and statute arrangement should be made. Third, Government official regulation article 36 and article 37 connected with purchase confirmation system should be supplemented and formality simplification effort may have to be achieved.
