The Parliamentary Government System as a Government Structure for the Realization of a Responsible Government

최근 한국에서는 대통령에 대한 불신이 만연해 있다. 심지어 사소한 말실수와 정책실패에도 대통령의 책임을 요구하며, 극단적인 경우 대통령의 퇴진을 요구하고 있다. 대통령의 권위가 땅에 떨어지고, 책임정치가 이루어지지 못하고 있기 때문이다. 우리 헌법은 대통령제를 채택하면서 책임정치를 위한 여러 제도를 규정하고 있다. 대통령에 대한 형사책임제도, 탄핵책임제도, 그리고 대통령을 대신한 각료(국무총리와 국무위원)에 대한 해임건의제도 등이 그것이다. 그러나 이 제도들은 책임정치를 위한 근본적인 제도가 되지 못한다. 왜냐하면 책임정치는 대통령을 비롯한 행정부 전체의 퇴진을 전제로 하는 경우에만 확실하게 실현되는데, 대통령의 중대한 실정으로 인하여 불신임이 극심하게 인정됨에도 불구하고 자진하여 사퇴하지 않는 한 강제로 물러나게 할 방법이 없기 때문이다. 이에 비하여 의원내각제는 책임정치를 실현함에 있어서 매우 좋은 정부형태로 평가된다. 왜냐하면 의원내각제는 행정부를 담당하는 내각이 불신임을 받으면 의회를 해산하고 총선거를 실시하여 국민의 심판을 받을 수 있기 때문이다. 결국 책임정치의 관점에서 여러 정부형태를 비교한 결과, 의원내각제가 책임정치의 실현에 가장 적합한 정부형태로 평가되며, 현실적으로도 우리 국민의 다양한 욕구를 반영하여 책임정치를 실현하기 위해서는 의원내각제로의 개헌이 요구됨을 알 수 있다.

There has been a profound mistrust by the people against the current presidency in Korea. Minor improprieties in speech and/or failures in policies are creating a commotion where the president is asked to take responsibility, or in extreme cases, fully withdraw from his position. More or less, abnormality is to the loss of authority of presidency as well as the lapse of a responsible government. Our constitution has several regulations to sustain a responsible government within the presidential government system: rules of impeachment and criminal responsibility of the president, along with the recommendation for removal of a high government official(prime minister, minister of state). However, such set of guidelines cannot be a foundation for a responsible government, for it denotes that a responsible government can only be realized when the president's entire administration steps down, which is rather impossible since there is no basis to enforce a non-voluntary retirement regardless of how much the president's credibility is being questioned. In comparison, the parliamentary government system can be viewed as a feasible structure towards achieving a responsible government. Under the parliamentary government system, (once the prime minister has non-confidence issues), it is quite practicable to re-evaluate his administrative cabinet and dismiss him by electing of the new prime minister. Looking at different government structures through the perspective of a responsible government, we can conclude that the parliamentary government system is the most suitable for the realization of a responsible government. To carry the wishes of the people, which long for a responsible government, it seems to be realistically appropriate and also necessary to reform the constitution to a parliamentary government system.
