Consideration of the Trustworthiness of Arbitrator in the International commercial Arbitration : With a special reference to IBA Guidelines

nternational commercial parties may be faced with various complaints or disputes from the others against in their transactions. But arbitration settlements have controversial problem for arbitrator(s) basically which is existed one of the common issues in arbitration market. Nobody coule trust arbitration process when there were arising matters of the arbitrator's bias or independence of one parties of disputes. Professional arbitrators experienced said that arbitration is strongly depended by arbitrators and good arbitration is basically related with good arbitrators. That is reason why we should consider trust of arbitrators and show impartiality and independence of arbitrator with parties, another arbitrator or others related a case in international commercial arbitration. In this paper was intended to understand confirmation and certain trust of arbitrators and the standard rule of IBA guidelines.
