노인의 주거보장에 관한 고찰

A Study of Residential Security for Senior Citizens

인구의 고령화는 다양한 사회경제적 문제를 초래하는데, 그 중 하나가 노인에 대한 복지문제이다. 물론 노인복지의 문제는 고령사회의 고유한 문제는 아니다. 언제 어디서건 고령자는 있기 마련이고 그에 따라 노인복지는 문제될 수 있기 때문이다. 그렇지만 고령사회에서의 노인복지는 양적 측면과 질적 측면에서 사회경제적으로 특유한 문제를 야기하고 새로운 사회 정책적 대응을 요구한다. 노인주거는 노인을 위한 주거라고 할 수 있는바, 문제는 노인의 개념과 그 개념에 해당하는 노인의 특수한 수요를 충당할 수 있는 주거의 개념을 어떻게 파악할 것인가에 있다. UN이 노령화지수의 기준으로 삼고 있는 65세 이상의 사람을 노인으로 파악하는 것이 바람직 할 것이다. 따라서 노인주거라 함은 65세 이상의 노인을 위한 주거라고 할 수 있고, 노인을 위한이라 함은 노인의 신체적·심리적·사회적 특성에 따른 수요를 충족시키는 여건을 갖춘 것으로 새길 수 있다 노인 단독 또는 노인부부로만 구성된 가구의 지속적인 증가, 자녀의 부모부양에 대한 책임의식의 감소, 노인가구의 취약한 경제사정, 현재의 열악한 주거실태 등을 감안할 때 이제라도 노인의 주거보장 정책을 수립하지 않고서는 고령화시대에 대응하는 정책이 마련될 수 없다고 생각된다. 고령 사회에 대응한 주거정책의 방향은 노인주거의 안정과 주거환경의 개선이라 할 수 이다. 첫째, 우리나라에서도 고령자 전용주택으로서 실비노인복지주택공급이 활성화되도록 하는 것이 필요하다. 이를 위해 필요한 경우에 주택법상의 주택으로 인정하는 규정의 법제화와, 중 저소득층의 입주가 가능하도록 공적 지원이 필요하다 둘째, 다양한 특성을 가진 고령자의 수요에 대응하려면 서비스가 제공되는 노인전용서비스주거의 공급도 활성화되어야 한다. 셋째, 많은 고령자가 자가 주택을 가지고 있으며, 주거이동을 원하지 않는 경향을 감안하여 주택개조를 지원하는 제도 마련이 필요하다. 이를 위해 우선 주택개조의 기준을 마련하는 것이 필요하며, 고령자의 소득 수준에 차이가 있음을 감안하여 개조비용을 지원하는 제도도 필요하다. 또한 주택개조가 쉬운 일이 아니므로 개조지원 창구 및 전문 인력육성이 필요하다고 사료된다.

One of socio-economic problem caused by aging of society will be the welfare of the aged. In the aging society, the welfare for senior citizens is related to the society it self in addition to the aged living in such society. The problem could be based on the situation where the welfare demand is increasing and of variety by the increase of the population of the aged and simultaneously the communitys burden for the welfare has been increasing because of the decrease of family support to its parents and relatives. The effect and policy implications of family changes on elderly care need to a proposal improvement of family maintenance the civil code basis for children supporting their old father and mother and reducing no-care of the basic livelihood guarantee law. Accordingly, this issue should be considered in a context which the aged can perform its living activities in the aging society from the point of human dignity. It also does require comprehensive, systematic, economic and efficient system corresponding to the current demand of welfare in consideration of aging society. This study purposes to analyze and review the legal system of senior citizen in Korea and to suggest the new legal systeme to correspond the aging society. This study propose that the legal system of senior citizens will be enlarged to all senior who have the needs of welfare.
