재판받을 권리의 구체화를 위한 일본의 법률구조제도연구

A Study on the Legal Aid System for Realizaton of the right to a trial in Japan

일본헌법은 법앞의 평등, 재판을 받을 권리를 규정하고 있다. 이 규정을 통하여 법률구조제도를 실질적인 권리로 인정하려고 노력하고 있다. 일본의 법률구조제도는 사법제도개혁의 하나로서 등장하게 된다. 여기서는 일본의 법률구조제도의 의의와 변화과정을 조사하고, 그리고 종합법률원조법과 지원센터의 내용을 알아본다. 특히, 2005년 제정된 종합법률원조법의 내용을 살펴본다. 구조할려는 대상의 확대, 장소와 시간의 약점을 극복하는 방안, 내용의 확대를 설명한다. 이를 통하여 우리의 법률구조제도의 발전에 참고가 되기를 바란다.
